Description
Summary:Probably, one of the most enigmatic figures in Matrimonial an Procedural Canon Law is the judicial "vetitum", i.e., the prohibition to marry that may be imposed by an Ecclesiastical Tribunal when it declares the nullity of marriage. This Canonical institution seems to enter in conflict with the natural right to marry in c. 1058 CIC, since it is configured as one of the main principles of Matrimonial Canon Law. This study trys to shed some light on the relationship between "vetitum" and "ius connubii" and intends to give an answer to a complex question: whether should the tribunal impose "vetitum" to a person that did not 'cause' the nullity of his/her first marriage, if there exists a positive doubt about the validity of the upcoming marriage that this person may contract
