Summary:The procedural problem of incompatibility between the shorter process concerning matrimonial cases an the iurium connected cases relating to the merely civil effects of marriage. Such a problem requires urgent solution in those countries where the Personal Statutes System is still in force, because of the exclusive legislative an juridical competence given to the Church over the aforementioned effects. The incompability is illustrated in three ways: the confirmation of the nullity of the marriage after the first affirmative sentence; the confirmation of documentary process decision and the confirmation of the sentence of seperation. A proposal by three procedural solutions, which can guarantee at the same time speed in matrimonial procedures and the requirements of the iurium connected cases, without violating the right of defense belonging to the parties
