Summary: | In recent decades, the legal form of the simulation of marital consent has had a remakable evolution in the jurisprodence of the ecclesiastical courts and in particular in that of the Roman Rota. This study traces this evolution, docussing on typical cases of simulation and attempting to identify some fundamental guidelines. What emerges is a progressive abandonment of the requirement of a positivus voluntatis actus, a greater consideration of the actual content of the colition to celebrate the wedding, a more unified vision of the various forms of simulation and, more generally, a greater attention to the psychological and human reality of the consent, which is closely inserted in the actual event of the marriage |
