Summary: | For more than 25 years, tribunals have aquired a practical knowledge of the Code's procedural law. There have been occasions when, in the interest of speeding the procedure along or in order to be more pastoral, laws have perhaps been rearranged, even forgotten, thereby risking injury to the sacred principles of justice and equity. This article is of a theoretical and practical nature. It offers a critical look at the application of the CIC/1983 and the instruction Dignitas Connubii. After a brief overview of the history and juridical nature of the instruction, a few preliminary questions are clarified, such as the determination of applicable laws and tribunal competence. The stages of a marriage nullity case are then examined - from the preliminary investigation to the sentence - alwys keeping in mind the protection of rights and respect for the principles of justice and equity |
