Summary:In the first five years following the publication of the motu proprio Mitis Iudex Dominus Iesus, certain dicasteries of the Roman Curia have issued several documents that, in their own ways, address the correct interpretation and implementation of the new norms governing marriage nullity trials. There was one common effort in Italy that led to some clarifications (the Tavola di lavoro), and each dicasterial participant has its own part to play in the just handling of marriage nullity causes subsequent to the reform. The Pontifical Council for Legislative Texts has replied to many questions, some of which may in fact be objective doubts of law. It could further serve the Church by updating the Instruction Dignitas connubii; some derogations that have occurred are proposed by the A. The Apostolic Signatura, too, offers general norms and illuminating direction in particular cases, while the Roman Rota’s procedural jurisprudence stands as a great service and aid to tribunals.
Au cours des cinq premières années suivant la publication du motu proprio Mitis Iudex Dominus Iesus, certains dicastères de la Curie romaine ont publié plusieurs documents qui, à leur manière, traitent de l’interprétation correcte et de la mise en oeuvre des nouvelles normes régissant les procès en nullité de mariage. Il y a eu un effort commun en Italie qui a conduit à quelques éclaircissements (la Tavola di lavoro), et chaque dicastère participant a son propre rôle à jouer dans le traitement juste des causes de nullité de mariage suivant la réforme. Le Conseil pontifical pour les textes législatifs a répondu à de nombreuses questions, dont certaines peuvent, en fait, faire l’objet de doutes objectifs de droit. Il pourrait en outre servir l’Église davantage en mettant à jour l’Instruction Dignitas connubii; certaines dérogations qui ont eu lieu sont proposées par l’A. La Signature apostolique offre également des normes générales et des directives éclairantes dans des cas particuliers, tandis que la jurisprudence procédurale de la Rote romaine constitue un grand service et une aide aux tribunaux.
