Summary: | Die COVID-19-Pandemie ist eine Ausnahmesituation, die in einem Rechtsstaat nur in den Grenzen des Rechts bewältigt werden darf. In erster Linie sind es effektiv umgesetzte Grundrechte, die sicherstellen, dass aus der regulierten Ausnahmesituation kein Ausnahmezustand wird, der sich jenseits des Rechts bewegt. Mit Blick auf das deutsche Infektionsschutzgesetz wird die Struktur grundrechtlicher Machtbegrenzung veranschaulicht. Hierbei spielt das Verhältnismäßigkeitsprinzip eine zentrale Rolle. Es wird durch einen Einschätzungs- und Gestaltungspielraum des Gesetzgebers und der Verwaltung ergänzt. During the COVID-19 pandemic a lot of measures (in Germany based on the Law on Communicable Diseases Control) have been implemented to tackle the crisis. Nevertheless, the rule of law has not been suspended. First and foremost, fundamental (human) rights (in Germany guaranteed by the constitution, the so-called Fundamental Law) ensure that legislators and the administrative branch work in compliance with the rule of law. In this context the principle of proportionality as well as the leeway of legislative and administrative decision-making demand particular attention. |
