Flores, Jerold Waltman provides a comprehensive history of the dispute and subsequent litigation that ultimately led to the Supreme Court's 1997 decision in City of Boerne v. Flores. Boerne, which announced the requirement that federal legislation enforcing the Fourteenth Amendment be “congruent and proportional” to the constitutional violations it sought to eradicate, was a seminal federalism and separation of powers decision. As with many important constitutional decisions, though, the case began as a purely local dispute.
