| Summary: | El can. 1733 introduce en el Código el concepto de “mediación” en el procedimiento administrativo, aunque como una actividad encomendada a personas autorizadas y no como un instituto jurídico específico. La doctrina canónica sobre este asunto es muy escasa y escasos son también los logros institucionales de los organismos para su realización, incluso los que se proponen en el mismo canon. El estudio ofrece algunas reflexiones teóricas sobre esta actividad y su uso correcto. Canon 1733 includes the concept of “mediation” in administrative procedures – as an activity entrusted to authorized persons, not as a specific legal framework. Canonical teaching on this matter is limited, and practical applications by specific organizations (even those cited in the canon itself) are likewise rare. This study offers a number of theoretical reflections on mediation and its appropriate application in practice. |
