Description
Summary:The present contribution concerns the study of the potestas iudicialis in a relational key. The investigation starts from the desire to bring out the relationship between the potestas regiminis and the iudicialis. This made it possible to study the different types of relations that existed between the diocesan Bishop, the Judicial Vicar and the other judges in the exercise of judicial power. The aim pursued was to verify if the relational dimension can represent a fundamental component of the judicial power and to demonstrate that we cannot disregard it for a complete and exhaustive comprehension of the theme. To this end, during the course of this study, the codic norms and the different innovations made by the Motu proprio Mitis Iudex Dominus Iesus of Pope Francis both in relation to the diocesan ecclesiastical Tribunals and in reference to the Vatican Ecclesiastical Court have been carefully examined, highlighting the points converging and divergent. What emerges clearly is the existence, in the exercise of judicial power, of a relational interdependence between the diocesan Bishop, the Judicial Vicar and the other Judges.
