| Summary: | A partire dalla normativa del m.p. Mitis Iudex Dominus Jesus, viene preso in considerazione il ruolo che rivestono le figure dell'istruttore e dell'assessore, previste nello svolgimento del processo breve. Dopo aver presentato il compito e le qualita richieste, viene messa in luce la loro azione all'interno della fase istruttoria (istruttore) e della fase decisoria (istruttore/assessore), il rapporto con il vicario giudiziale, prima, e il vescovo diocesano, poi, unico giudice nel predetto processo. Starting from the m.p. Mitis Iudex Dominus Iesus, the role of the instructor and of the assessor, as they are envisaged in the brieferprocess, is considered. After presenting the task and the necessary qualities required of each, their action within the instructing phase (for the instructor) and the decision phase (for the instructor/assessor) is highlighted, as well as their relationship first with the judicial vicar, and then with the diocesan bishop, who is the sole judge in the briefer process. |
