| Summary: | Il presente contributo intende offrire da un lato una lettura delle specifiche indicazioni normative promulgate dal Santo Padre con riferimento alla indagine pregiudiziale o pastorale, nel più ampio contesto della riforma delle norme sulle procedure di nullità matrimoniale, dall'altro vuole sottolineare il ruolo che l'avvocato nel foro ecclesiastico è chiamato a svolgere nell'ambito di tale specifica indagine, presentando i profili problematici che tale novità comporta sia nel giudizio in senso stretto, sia nel più ampio orizzonte pastorale cui la normativa fa esplicito riferimento. The contribution examines on the one hand the regulatory guidelines offered by the Pope about the prejudicial or pastoral inquiry in the wider context of the reform of the procedures for the declaration of marriage nullity, and on the other wants to emphasize the role of ecclesiastical lawyer in this particular inquiry, presenting the problematic aspects of the reform both in the judicial phase and in the broader pastoral horizon of the reform. |
