Summary:The article develops a consideration on the qualification of canonical marriage, traditionally defined as a contract, to highlight how this definition obscures the sacramental nature of the same. With regard to marriage, codex iuris canonici, next to the expression contractus, makes use of the term foedus. It is this definition, rather than that of contract, which better expresses the sacramental nature of marriage and gives importance to the personal dimension of the same, as expressed in the Vatican II ecumenical Council.
