Description
Summary:The article presents problematic issues regarding the admission of a case of marriage nuillity for ordinary examination at a second degree of judgment. After having outlined a normative frame, it analyzes the various situations that would require such provision. It concentrates, therefore, on how to set up the corresponding decree, with specific reference to the reasons that have rendered it necessary, and particularly to supply such reasons clearly first and foremost to the interested parties. Subsequently, it treats the formulation of the doubt, taking in examination three problematic situations that could occur at this phase of the process. It concludes with some practical observations and the proposal of three examples of such decree.
