Description
Summary:The sentence, which concludes the canonical process for the declaration of marriage nullity, is the act with which the college of judges, in answer to a question of whether in the concrete case the examined marriage is null, exposes the reasons that support that same answer on the basis of principles and norms in canonical law and the understanding that the judges would have reached for that examined marriage. The article, which takes up the conference given by the author during a course of applied canon law, held in Perugia in 2012, in examining the several parts in which a sentence is subdivided, recalls what current norms demand to be present in the document and tackles some issues that could crop up, by offering suggestions so as the decision of the judges can appear convincingly communicated, besides ist being juridically correct. The main attention is adressed to the interested faithful, who must be able to find, in the text, an answer that is offered to them in a comprehensible language and form, respectful of the examined situation and of the persons involved, rigorous in ist presentation of the cited arguments and supportive of the given answer.
