Summary: | The article aims to provide an overview of the manifestation form of the "intentio simulatoria" in the canonical tradition of marriage. Initially, the article focuses on the medieval canonical doctrine, with an examination of the decrees of Innocent III Tua Nos, Gregory IX Si condiciones, Innocent IV Habemus and the canon Aliquando contained in Gratian Decree. Finally, we examine the doctrine of Cardinal Gasparri that for the first time individualized the term "positive act of will" adapting his Tractus Canonicus de matrimonio to the Code of Law of 1917.
