Summary: | In the contemporary reflection on the validity of the laws with moral value, three different positions have been outlined: the liberal position, according to which the moral laws would be intrinsically unjustified, since they would violate the autonomy or the right to the moral independence of the individuals; the collectivist or communitarian position, for which the moral laws would justify themeselves providing that they were suitable to reinforce and to support the social cohesion; and the position that defends the "Central Tradition of West", for which the moral laws worth and force always and when his contents are ethically right because they rely on the natural right, and his application be suitable. The article is orientated to present this latter position and to support her force and need in the current situation |
