| Summary: | El estudio presentado se inicia con el análisis de la disolución del matrimonio como "excepción" al principio de indisolubilidad. Luego se estudian los fundamentos escriturísticos del privilegio paulino y su influencia en la tradición canónica en el Decreto de Graviano. Las Decretales pontificias Quanto y Gaudemos de Inocencio III suponen una contribución decesiva a este tema. El estudio continua analizando las fuentes canónicas hasta la primera codificación en lo que se refiere a esta materia. Concluye en ensayo con el estudio de la Instrucción Ut notum de Pablo VI, así como con el análisis de la normativa codicial actual y las Normas de 30 de abril de 2001. The prsented study begins with the analysis of the dissolution of the marriage as "exception" to the indissolubility priciple. Then the biblical foundations of the Pauline privilege and his influence in the canonical tradition in Decretum Gratiani are studied. The Pontificial Decretals Quanto and Gaudemos of Pope Innocent III suppose a decisive contribution of this topic. The study continue analyzing the canonical sources up to the first codification regarding this matter. The essay concludes with the study of the Instruction Ut notum of Pope Paul VI, as well as with the analysis of the canonical regulation and the Normae of April 30, 2001 |
