Summary: | he paper studies the practice of judging marital separation cases in the ecclesiastical court of Freising in the second half of the fifteenth century. The first chapter outlines the legal position for separating marriages from bed and board as practiced in the later Middle Ages, locating the practice between canon law, the communis opinio of legal scholars and regional traditions. Using the extensive documentation of the act books of the court in Freising, the paper then systemati cally analyses separation processes and judgement patterns under two judges. The results reveal a number of similarities, but also distinct differences between the way the two judges treated separation cases, indicating the importance of the role of the individual judge as a variable be tween the ius commune and regional legal traditions. Der Aufsatz untersucht den Umgang mit ehelichen Trennungsfällen am Freisinger Offizialat in der zweiten Hälfte des 15. Jahrhunderts. Einleitend wird die rechtliche Lage der spätmittel- alterlichen Praxis von Ehetrennungen von Tisch und Bett im Spannungsfeld zwischen kanoni- schem Recht, der communis opinio der Rechtsgelehrten und regionalen Bräuchen beschrieben. Anschließend werden anhand der umfangreichen Dokumentation der Freisinger Gerichtsbücher Prozesse und Urteile in Trennungsfällen unter zwei Richtern systematisch untersucht und Ver fahrensmuster herausgearbeitet. Die Ergebnisse zeigen einerseits Ähnlichkeiten, andererseits aber klare Unterschiede in der Rechtsprechung der zwei Richter, die die Rolle des individuellen Richters als Variable neben dem ius commune und regionalen Rechtstraditionen deutlich machen |
