| Summary: | Inquisition procedure at the Holy Office - Legal Facets and Perspectives of analysis. The pre sent essay examines institutional and normative aspects as well as the structure and the procedure of the Holy Office in condemning heresy, with a special focus on the 19 th century. Beginning with a description of heresy and its relevance for criminal policy, the author considers the Inquisiti on not only as a tribunal with its own rules, but also as an institution that was integrated into a general legal system, which therefore cannot be understood as an impermeable and completely separated institution. Keywords: Roman Inquisition, Holy Office, heresy, fiscal proctor, manuals for inquisitors Die vorliegende Abhandlung untersucht das Inquisitionsverfahren beim Heiligen Offizium in seinen juristischen Aspekten und dessen Analysenperspektiven. Betrachtet werden die Struktur und Verfahrensweise des Heiligen Offiziums bei der Bekämpfung der Häresie sowie seine insti- tutionellen und normativen Aspekte mit besonderem Blick auf das 19. Jahrhundert. Beginnend mit einer Beschreibung des Häresiedelikts und dessen kriminalpolitischer Bedeutung wird die Inquisition nicht nur als Tribunal mit eigenen Regeln untersucht, sondern auch als eine in einem allgemeinen juristischen System eingegliederte Institution, die nicht als undurchlässig und völlig abgesondert verstanden werden kann |
