Zumeist werden die im Lateinischen verwendeten Gehorsamsbegriffe im Deutschen nicht immer mit "gehorchen" übersetzt. Den meisten Kommentaren lässt sich entnehmen, dass eine solche Gehorsamsforderung im Rahmen des Ehenichtigkeitsverfahrens vorhanden ist. Wie jedoch diese Forderung inhaltlich zu verstehen ist, darüber schweigen der Gesetzgeber wie auch die meisten Kommentare. Fordert ein Richter Gehorsam von prozessbeteiligten Parteien, dann bezieht sich die Gehorsamspflicht auf alles, was sich aus dem geltenden Recht ableiten lässt. Es ist folglich zu unterscheiden ziwschen bloßem Fehlverhalten und Gehorsamsverletzung, dem Einhalten rechtlicher Vorschriften sowie dem Befolgen des im Einzelfall angeordneten Gehorsams. Das Ziel der Gehorsamsforderung ist die Sicherung der kirchlichen Disziplin im laufenden Ehenichtigkeitsverfahren. Der Fokus dieser Arbeit ist auf jene Verfahren gelegt, die die Nichtigkeit der Ehebehandeln. Grundlage der Studie sind der Kodex von 1917, die Instruktion Provida Mater Ecclesiae von 1936, der Kodex von 1983 und die Instruktion Dignitas Connubii von 2005. Unter Bezugnahme auf die vier Rechtsquellen werden dargestellt: der sprachliche Befund, Ehrfurcht und Gehorsam gegenüber dem kirchlichen Gericht sowie die Gehorsamsforderung im Kontext der prozessbeteiligten Parteien, der Zeugenladung und -vernehmung, der Vorlage prozessrelevanter Urkunden und des Sachverständigen | ||
