Summary:The main object of this work is the indissolubility of Marriage with the reference to some specific issues concerning nullity, Separation and Divorce, analyzed form the point of view of the Canon Law of the Catholic Church and the Serbian Orthodox Church. An attempt is made to compare the two standards under certain aspects of matrimonial and procedural Law and, in particular, takes into account the final specifications set forth in the Instruction Dignitas Conubii, documents issued by the Supreme Tribunal of the Apostolic Signatura in 2006 and 2007, and by the Pontifical Council for Legislative Texts in 2003. The proposed theme refers to the verification of the free state of a member of the Serbian Orthodox Church under three aspects. The foirst, the most common, concerns a member of a Serbian Orthodox Church who, having been previously married in the Orthodox Church to an Orthodox and having obtained a Divorce from an Orthodox Ecclesiastical Court, comes to the Catholic Church with the intention of celebrating a new Marriage to a catholic. The second concerns an orthodox who has been previously married but only in a civil Marriage. Finally, the third aspect refers to the possibility of recognizing some of the Decisions of the Ecclesiastical Courts of the Serbian Orthdox Church by those of the Catholic Church.
