Dennoch erforderte die verfassungsrechtliche Restrukturierung durch das II. Vaticanum eine Neukodifizierung, bei der nicht die theologische oder ekklesiologische Qualität wichtigstes Endergebnis, sondern der Wechsel von hermeneutischen Prinzip der Vernunft zu dem des Glaubens ist. Ferner ist jetzt der Gläubige Hauptsubjekt. Die "Communio" hat Verfassungsrang. C. zeigt auf, was im CIC ganz oder teilweise von der kulturellen oder juristischen Konzeption der alten Kodifizierung geprägt ist und wo beispielhaft Probleme auf dem Gebiet der Ekklesiologie bestehen. Abgesehen von leichten sprachlichen Veränderungen in den Anmerkungen identisch mit dem gleichnamigen Aufsatz in: AKathKR 152 (1983), 3-30
