Starting from the historical evolution of marriage as a juridical institution, it highlights the progressive separation between civil and religious dimensions and the emergence of new family models. Particular attention is given to the rules established by the Codex Iuris Canonici and the Italian Episcopal Conference’s General Decree on Canonical Marriage (dgmc), which strictly limit the celebration of marriages without civil transcription, while providing specific exceptions. The study analyzes these exceptions (articles 40, 41, and 44 dgmc), the conditions for delayed transcription, and the implications for the rights and duties of spouses. The conclusion underlines the sacramental essence of canonical marriage, independent of civil effects, and reflects on the balance between religious freedom, state regulations, and the pastoral care of the faithful. | ||
