| 520 | |a L’articolo affronta il tema della destinazione degli archivi degli enti ecclesiastici in seguito alle varie vicende estintive o profondamente modificative di questi ultimi. Dopo aver trattato delle fattispecie astratte codicistiche (dell’estinzione, della congiunzione e della divisione) ed extra-codicistiche (della trasformazione, per esempio, di una chiesa parrocchiale in chiesa rettoria), e aver analizzato le diverse fattispecie concrete corrispondenti, sono analizzate le norme applicabili per analogia in materia di archivi, enucleando i criteri normativi che possano fare da guida anche per gli archivi che non sono ancora di interesse storico e che sembrano rimanere fuori da ogni esauriente normativa. Inoltre, vengono esposte brevemente le prassi di alcune diocesi italiane ed estere, giustificate per l’assenza di una normativa completa sull’argomento. Infine, si propone una gerarchia di principi e di criteri (principali e sussidiari) che possano costituire delle linee guida per una legislazione particolare organica o almeno per indirizzare le prassi diocesane, auspicando tuttavia, infine, l’intervento, ritenuto necessario, del Legislatore superiore in materia. | ||
| 520 | |a The article addresses the issue of the destination of ecclesiastical archives following various events that would have led to their extinction or profound change. After discussing abstract cases covered by the Code (extinction, union, and division), and cases not covered by the Code (such as the transformation of a parish church into a non-parochial church), and having analysed the various corresponding concrete cases, the rules applicable by analogy to archives are analysed, identifying the regulatory criteria that can also serve as a guide for archives that are not yet of historical interest and seem to remain outside any comprehensive legislation. In addition, the practices of some Italian and foreign dioceses are briefly outlined, given the absence of comprehensive legislation on the subject. Finally, a hierarchy of principles and criteria (main and subsidiary) is proposed that can serve as guidelines for specific comprehensive legislation or at least to guide diocesan practices, while ultimately hoping for the intervention of the Supreme Legislator, deemed necessary, on the matter. | ||
