| Sumario: | O discurso do Pontífice à Rota Romana abre a cada ano os trabalhos deste Tribunal Apostólico e é aguardado com expectativa pelos envolvidos na ação judiciária da Igreja, tornando-se uma referência para todos os tribunais eclesiásticos. Bento XVI reflete sobre a família na perspectiva jurídica, mas fundamenta seu pensamento na teologia e na filosofia com abertura para a antropologia. Dividido em três grupos, o artigo tem a finalidade de expor o pensamento de Bento XVI sobre a ação dos tribunais e a direta contribuição que exercem sobre a teologia do matrimônio, considera a questão da hermenêutica canônica na mesma linha da reflexão teológica sobre a hermenêutica de continuidade que marcou o Concílio Vaticano II e reconhece a família como uma instituição divina e inscrita na natureza humana. A metodologia utilizada foi o contato direto com os textos publicados no periódico semanal da Santa Sé e a conclusão do trabalho é que Bento XVI elabora uma teologia do direito matrimonial aberta ao diálogo, aos desafios da cultura atual, alicerçada na natureza humana e no sacramento. The speech of the Pope to the Roman Rota opens every year the work of this Apostolic Tribunal and is awaited with anticipation by those involved in the judicial action of the Church, becoming a reference for all ecclesiastical tribunals. Benedict XVI reflects on family in the legal perspective, but he bases his thinking in theology and philosophy with opening for anthropology. Divided into three groups, the article aims to expose the thought of Benedict XVI on the action of the tribunals and the direct contribution they have on the theology of marriage He considers the question of canonical hermeneutics in the same line of theological reflection on hermeneutics continuity that marked the Vatican II Council and recognizes the family as a divine and inscribed in human nature institution. The methodology used was direct contact with the texts published in the weekly newsletter of the Holy See and the completion of the work is that Benedict XVI elaborates a theology of matrimonial law open to dialogue, to the challenges of today's culture, rooted in human nature and in the sacrament. |
