This article aims to critically analyse the notion of 'threat' as interpreted and applied by the Valdivia Court of Appeals in a recent ruling. The case involves a protection claim filed by the Mapuche Huilliche community against the Ministry of Public Works. The court denied the constitutional protection action, and the uniqueness of the decision lies in the concept of threat used by the Court. What's innovative is the idea of a 'future threat' in a preventive manner, meaning the protection claim is filed before the threat materializes. This would expand the scope of the protection remedy. The consequence of using this concept is that it extends the remedy to cases that are not currently covered. | ||

El presente articulotiene como objetivo analizar críticamente la noción de ‘amenaza’ tal como fue interpretada y aplicada por la Corte de Apelaciones de Valdivia en una sentencia reciente. Se trata de un caso de un recurso de protección interpuesto por la comunidad mapuche Huilliche contra el Ministerio de Obras Públicas. La sentencia denegó la acción constitucional de protección y la singularidad de la decisión radica en el concepto de amenaza que usa la Corte. Lo innovador es la idea de ‘amenaza futura’ de forma preventiva,es decir interponer el recurso de protección antes de que se materialice la amenaza. Esto ampliaría la cobertura del recurso. La consecuencia del uso del concepto es que extiende el recurso a casos que no están cubiertos actualmente. | ||
