Chacun de ces cas est réglé par le droit, mais il peut arriver que les normes canoniques prévues ne soient pas respectées, ce qui constitue une violation de la loi et peut donner lieu à un abus de pouvoir. L’observation des règles du droit est de nature à préserver la justice et à éviter tout conflit. En cette matière, la grande majorité des recours sont introduits par des clercs, ce qui ne doit pas surprendre, puisque que c’est essentiellement sur eux que repose la fonction de gouvernement, selon le c. 129 § 1 : «Au pouvoir de gouvernement, qui dans l’Église est vraiment d’institution divine et est encore appelé pouvoir de juridiction, sont aptes, selon les dispositions du droit, ceux qui ont reçu l’ordre sacré.» Toutefois, cet énoncé ne signifie pas que les fidèles laïcs en soient totalement écartés. En effet, au second paragraphe du même canon, il est déterminé qu’au titre de leur statut de christifideles, reposant sur le fondement sacramentel du baptême, ils peuvent coopérer à ce même pouvoir de gouvernement («ad normam iuris cooperari possunt»). C’est en vertu de cette norme qu’aujourd’hui un certain nombre de laïcs reçoivent des offices et des charges, qui les font participer à la fonction de gouvernement dans l’Église. Il n’est donc pas exclu qu’une personne laïque puisse également avoir recours à la justice administrative à propos d’une nomination, d’une révocation ou d’un transfert… | ||
