| Summary: | Cette étude est une analyse comparative du droit pénal révisé des Églises catholiques latine et orientale. Il existe des similitudes frappantes entre ces droits pénaux révisés en raison de leurs sources communes, mais aussi des dissemblances, principalement parce que la Commission de révision a intégré les normes révisées dans la vision, le cadre, la structure, les termes et les numéros de canons existants du CCEO, en laissant intacte l’harmonie interne du code déjà existant. L’étude constate que cette révision des canons correspond aux besoins des Églises orientales et est cohérente avec l’esprit du droit pénal de ces Églises tel qu’il a été envisagé par les codificateurs du CCEO. This study is a comparative analysis of the revised penal law of the Eastern and Latin Catholic Churches. There are striking similarities between these revised penal laws due to their common sources, but there are also dissimilarities, mainly because the revision commission integrated the revised norms into the existing vision, framework, structure, terms, and canon numbers of the CCEO, leaving intact the internal harmony of the already existing code. The study finds that this revision of the canons corresponds to the needs of the Eastern Churches and is coherent with the spirit of the penal law of those Churches as envisaged by the codifiers of the CCEO. |
