We maintain that while objective factors perform a purely descriptive function in that they help explain the actual price that a good has, subjective factors also play a normative function to the extent that they explain how these factors should be formed. More specifically, we defend the position that the subjective factors expressed in the "common estimation" to which Vitoria refers should be considered the only normative criteria that are relevant when it comes to determining a just price. The reason is that the existence of a common estimation guarantees that no party be able to take advantage of the necessity of any other or-which is the same thing-the intent of any party find itself encumbered by necessity. | ||

De conformidad con dicha analogía, sostenemos que en la teoría del justo precio de Vitoria concurren factores subjetivos y objetivos, que hacen las veces de la forma y de la materia del precio, respectivamente. Sostenemos que mientras los factores objetivos cumplen una función puramente descriptiva, en tanto contribuyen a explicar el precio que de hecho tiene un bien, los factores subjetivos desempeñan además una función normativa, en la medida en que explican cómo éstos se deben formar. Más concretamente, defenderemos que los factores subjetivos expresados en la "estimación común" de que habla Vitoria deben ser considerados como los únicos criterios normativos relevantes a la hora de determinar el justo precio. La razón es que la existencia de una estimación común garantiza que ninguna de las partes pueda aprovecharse de la necesidad de la otra o, lo que es lo mismo, que la voluntariedad de ninguna de las partes se encuentra lastrada por la necesidad. | ||
