Alcune definizioni, che erano presenti e centrali nella precedente legislazione, quali quelle di «Congregazione», «Pontificio Consiglio» e «Istituto», sono scomparse nella PE. Altre (cioè quelle di «Dicastero» e «Ufficio») hanno cambiato significato rispetto alla PB. In particolare, appare degna di nota la nuova denominazione di «Istituzione curiale» che compare nella PE (tra singolare e plurale) oltre 40 volte. L’impressione è che il nuovo concetto sia stato introdotto per avere un termine in cui poter includere tutti gli enti che formano la Curia romana secondo la ripartizione adottata da PE. Tuttavia, vi è la sensazione che tale introduzione sia avvenuta, probabilmente, in una fase già avanzata della redazione del testo della PE, cosa che spiegherebbe come mai non si sia riusciti ad armonizzare completamente il testo della Costituzione, con il risultato di creare incertezze in merito a quali delle «Istituzioni curiali» si applichi effettivamente questo o quell’articolo della PE. Among its many innovations, the Apostolic Constitution on the reform of the Roman Curia Praedicate evangelium (= PE) has also introduced a different terminology in order to name the bodies of the Curia when compared to John Paul II’s Apostolic Constitution Pastor bonus (= PB). Some definitions, which were present and central in the previous legislation, such as those of «Congregation», «Pontifical Council» and «Institute», have disappeared from PE. Other ones (namely those of «Dicastery» and «Office») have changed their meaning in comparison to PB. A specific attention seems to be deserved by the new denomination of «Curial Institution», which appears in PE more than 40 times. The idea that emerges is that the new concept was introduced in order to have a definition in which every institution forming the Roman Curia according to the criteria of PE could be included. However, one cannot but assume that such introduction probably took place during an already advanced stage of the drafting of PE, which would explain the reason why the text of the Apostolic Constitution could not be totally harmonized, resulting in uncertainties about which «Curial Institution» is actually affected by the application of the various articles of PE. |
