| Riepilogo: | Many religious entities are the subject of defamatory expressions or accusations of having committed illicit acts that may harm their honor, the religious sentiments of their members, and even the freedom of religious choice of third parties. It is necessary to apply the rules governing the conflict between freedom of expression and the right to honor (in this case, of a private legal entity) to determine whether the former prevails, or if we are dealing with unlawful defamatory acts. We will analyze this dispute based on some activities carried out by a Spanish association and various statements published in media and social networks that denigrate the Jehovah’s Witnesses, considering the constitutional jurisprudence and that of the European Court of Human Rights, particularly about Jehovah’s Witnesses in Russia. The text is a translation of an article published in the Revista General de Derecho Canónico y Eclesiástico del Estado (Ferreiro Galguera 2023) before the recent Spanish decisions discussed in the article by Massimo Introvigne in this issue of The Journal of CESNUR. |
