Estos enfoques, demarcan la necesidad de hacer hincapié en el individuo como sujeto de derechos, con capacidad para tomar decisiones, y analizar las diversas barreras contextuales que le impiden el goce efectivo de derechos humanos, de manera, que constituyen lentes teóricos y metodológicos que tienen impacto en el plano fáctico de ejercicio de los derechos.Entonces, si se estudia el acceso a justicia de personas con discapacidad, se pueden observar diversas barreras que denotan el ejercicio de violencia institucional por parte del poder judicial. Así, el análisis del caso J.M.I permite observar cómo las prácticas judiciales desprovistas de los enfoques del marco internacional de los derechos humanos, conllevan el ejercicio de violencia y además, expone la importancia de la remoción de obstáculos contextuales para el pleno goce de las mujeres con discapacidad de sus derechos, derrocando las decisiones discriminatorias que han caracterizado el actuar del Poder Judicial y múltiples estereotipos sociales vinculados al ejercicio de derechos sexuales y reproductivos por las mujeres con discapacidad.En definitiva, el estudio de este caso pone de manifiesto que el modelo social de la discapacidad, los enfoques de derechos humanos, géneros e interseccionalidad, permiten visibilizar las barreras que el entorno y la sociedad le imponen a las mujeres con discapacidad en el ejercicio de los derechos, y denota cómo a partir de análisis contextuales, situados e integrales, es posible realizar cambios concretos en la forma de actuar del Poder Judicial, que conducen al reconocimiento del pleno ejercicio de los derechos humanos de las personas con discapacidad, erradicando discriminaciones y violencias. | ||

These approaches show the need to emphasize the individual as a subject of rights, with the capacity tomake decisions, and to analyze the various contextual barriers that prevent the effective enjoyment of human rights in such a way that they constitute theoretical and methodological lenses that have an impact on the factual level of the exercise of rights. So, if access to justice for people with disabilities is studied, various barriers can be observed that denote the exercise by judges of institutional violence. Thus, the analysis of the J.M.I case allows us to observe how judicial practices devoid of the approaches of the international human rights framework lead to the exercise of institutional violence and also allows us to assume the importance of removing contextual obstacles for the full enjoyment of people with disabilities of their rights, overthrowing the institutional violence that has characterized the actions of the Judiciary and multiple social stereotypes linked to the exercise of sexual and reproductive rights by people with disabilities. In short, the study of this case shows that the social model of disability, the human rights, gender, and intersectionality approaches, make it possible to make visible the barriers that the environment and society impose on women with disabilities in the exercise of their rights, and shows how, based on contextual, situated and comprehensive analyses, it is possible to make concrete changes in the way the Judiciary acts, which lead to the recognition of the complete exercise of the human rights of persons with disabilities, eradicating discrimination and violence. | ||
