Plus qu’une expertise théorique du droit transversal à son œuvre, la vie d’Albert le Grand a été marqué par une participation régulière à divers tribunaux d’arbitrage. Le « Grand arbitrage » scellé le 28 juin 1258 dans le conflit qui opposait Conrad von Hochstaden, archevêque de Cologne, et les bourgeois de la même ville, est un témoin de premier choix pour comprendre les activités du Doctor universalis et son implication directe en matière de pouvoir judiciaire. Répartition des différentes juridictions spirituelle et temporelle, engorgement des tribunaux, défense d’un droit des prisonniers, douanes et monnayages, corruption pour les élections des échevins sont autant de problématiques que traite le « Grand arbitrage » auquel participe Albert le Grand et y appose son sceau de lecteur du Couvent dominicain de Cologne. La participation d’un autre grand dominicain, Hugues de Saint-Cher (1200-1263), à ces mêmes tribunaux devient un enjeu de recherche pertinent pour positionner l’histoire de l’Ordre des Prêcheurs et l’évolution épistémologique d’une théologie exclusivement compartimentée à la lecture des Ecritures vers une théologie perméable aux autres savoirs au 13e siècle. Dès lors, il sera nécessaire de s’interroger sur l’impact de tels épistémès théologiques en matière d’herméneutique juridique. Est-il envisageable de penser une herméneutique du droit qui soit perméable aux autres disciplines ou doit-on la laisser compartimentée en elle-même par peur d’être contaminée -et corrompue- par les autres savoirs ? Tel est l’enjeu de notre investigation qui alimentera le dossier doctrinal et historico-biographique de nos deux auteurs . | ||

More than a theoretical expertise of law transversal to his work, Albert the Great’s life was marked by a regular participation in various arbitration courts. The « Great Arbitration », sealed on 28 June 1258 in the conflict between Conrad von Hochstaden, Archbishop of Cologne, and the burghers of the same city, is a prime witness to understanding the activities of the Doctor universalis and his direct involvement in matters of judicial power. The distribution of the various spiritual and temporal jurisdictions, the overloading of the courts, the defence of prisoners’ rights, customs and coinage, and corruption in the election of aldermen are all problems dealt with by the « Great Arbitration » in which Albert the Great participated and affixed his seal as a lector of the Dominican convent of Cologne. The participation of another great Dominican, Hugues de Saint-Cher (1200-1263), in these same tribunals becomes a relevant research issue in order to position the history of the Order of Preachers and the epistemological evolution of a theology exclusively compartmentalized in the reading of the Scriptures towards a theology that is permeable to other knowledge in the 13th century. It will therefore be necessary to examine the impact of such theological epistems on juridical hermeneutics. Is it possible to think of a hermeneutic of law that is permeable to other disciplines or should it be left compartmentalised for fear of being contaminated –and corrupted– by other knowledge ? This is the challenge of our investigation, which will feed the doctrinal and historico-biographical dossier of our two authors. | ||
