Cet article examine les systèmes juridiques séculiers et canoniques en relation avec ce délit. Tout d’abord, l’histoire juridique et législative de la pédopornographie aux États-Unis est passée en revue. Ensuite, il explore ce délit dans le droit canonique, en examinant la jurisprudence, les peines possibles et le délai de prescription actuel. Enfin, l’article pose la question de l’avenir de l’Église en ce qui concerne le délit de pédopornographie. | ||
| 520 | |a The child sexual abuse scandals have been addressed by the Catholic Church with numerous public statements, legal actions, modifications of procedures and practices, and changes to canon law. A related issue that has not received the same level of response or scrutiny from the Church is the delict of child pornography. This article examines secular and canonical legal systems in relation to this delict. First, the legal and legislative history of child pornography in the United States is reviewed. Second, this delict in canon law is explored, examining the jurisprudence, possible punishments available, and the current prescription period. Finally, the article posits the question of where the Church goes from here in relation to the delict of child pornography. | ||
