The legislature leaves no doubt that marriage is unwaivable right of human and this is the core element of the catholic Canon Law. This principle radiates to the regulation of matrimonial impediments too. So, it is possible to restrict this fundamental right, only via the legislature's utmost restraint. But, impediments created within boundaries cannot be considered as unauthorized restriction of ius connubii. As the marriage is a bond between a man and a woman, the partner's dignity deserves legal protection. The institution of marriage itself, its dignity and its sacramental character must be legally protected. It is the interest of the community as well that marriage should get legal protection and marriage cannot be contracted under certain circumstances. In this study I am trying to clarify the basic principles regarding relationship between ius connubii and matrimonial impediments. It is a delicate boundary, in which the legislature protects the dignity of the marriage, the other party and the community, but at the same time he guarantees the right to the marriage as extendedly as possible. | ||

Der Gesetzgeber lässt keinen Zweifel daran, dass die Ehe unabdingbares Recht des Menschen ist und dies ist das Kernstück des katholischen Kirchenrechts. Dieser Grundsatz betrifft auch die Regelung der Ehehindernisse. Es ist also möglich, dieses Grundrecht einzuschränken, allerdings nur durch äußerste Zurückhaltung des Gesetzgebers. Hindernisse jedoch, die innerhalb von Grenzen geschaffen werden, können nicht als unerlaubte Einschränkung des ius connubii angesehen werden. Da die Ehe eine Verbindung zwischen einem Mann und einer Frau ist, verdient die Würde des Partners rechtlichen Schutz. Die Institution der Ehe selbst, ihre Würde und ihr sakramentaler Charakter müssen rechtlich geschützt werden. Es liegt auch im Interesse der Gemeinschaft, dass die Ehe rechtlich geschützt wird und die Ehe unter bestimmten Umständen nicht geschlossen werden kann. In dieser Studie versuche ich, die grundlegenden Prinzipien bezüglich des Verhältnisses zwischen ius connubii und Ehehindernissen zu klären. Es ist eine heikle Grenze, innerhalb derer der Gesetzgeber die Würde der Ehe, den Ehepartner und die Gemeinschaft schützt, aber gleichzeitig das Recht auf die Ehe so weit wie möglich garantiert. | ||
