Le autorità civili, al fine di evitare pericolosi assembramenti che avrebbero potuto favorire il contagio da coronavirus, hanno infatti vietato la partecipazione del popolo alle celebrazioni, impedito incontri di catechesi e, in certi casi, anche negato il conforto religioso a chi era nell’imminenza della morte. Questo articolo, dopo aver illustrato la dottrina cattolica della libertà religiosa e della libertas Ecclesiae delineata nella dichiarazione Dignitatis humanae, sintetizza le misure di contenimento della pandemia adottate in Italia, Francia e Stati Uniti, fornendo per ciascuno di essi un giudizio circa la compatibilità delle limitazioni imposte con l’insegnamento della Chiesa. Nella conclusione, il particolare favore garantito dagli ordinamenti giuridici civili alla libertà religiosa viene giustificato non solo sulla base dei diversi testi costituzionali ma anche della capacità della fede religiosa di far trovare (o almeno far cercare) una risposta ai bisogni fondamentali di ogni uomo, che specie nei momenti difficili ricerca senso e conforto. | 520 | |a The restrictions imposed in many countries during the emergency period caused by the last pandemic that affected the entire hemisphere, due to SARS-CoV-2, also severely restricted the exercise of religious freedom. The civil authorities, in order to avoid dangerous gatherings that could have fostered the contagion of the coronavirus, prohibited the participation of the people in celebrations, prevented catechesis meetings and, in some cases, even denied religious comfort to those on the verge of death. This article, after illustrating the Catholic doctrine of freedom of religion and libertas Ecclesiae outlined in the declaration Dignitatis humanae, summarises the pandemic containment measures adopted in Italy, France and the United States, providing for each a judgement on the compatibility of the limitations imposed with Church teaching. In conclusion, the particular favour granted by civil legal systems to religious freedom is justified not only on the basis of the various constitutional texts, but also on the basis of the capacity of religious faith to find (or at least seek) an answer to the fundamental needs of every man, who especially in difficult times seeks meaning and comfort. | ||
