| 520 | |a La struttura essenziale delle Comunità gerarchiche della Chiesa, fondata sulla componente comunitaria e sulla cura pastorale affidata al ministero del Vescovo e del Parroco, così come è emersa dal Concilio Vaticano Il, impone particolare cautela nella considerazione di tali soggetti istituzionali che devono essere intesi a partire dalla loro natura ontologica. L'aspetto meramente operativo - patrimonialistico e, più in generale, negoziale - non caratterizza tali soggetti, ma semplicemente ne rappresenta un aspetto funzionale. La personalità giuridica di cui "godono" Diocesi e Parrocchia non si pone, infatti, come criterio per la loro classificazione fra i c.d. soggetti di diritto: Diocesi e Parrocchia non "sono" persone giuridiche ma "godono" della personalità giuridica e, nel compimento delle attività negoziali, sono rappresentate dal Vescovo e dal Parroco. Anche la natura giuridica della rappresentanza non può, quindi, essere ricondotta alle teorie organicistiche che caratterizzano gli Enti in genere ma va analizzata in ragione dell'effettiva operatività ad essa riservata nello specifico ambito delle Comunità gerarchiche. | ||
| 520 | |a The essential hierarchical Entities structure of the Church, founded on the Community component and on the pastoral care entrusted to the ministry of the bishop and the parson, as it issued from the second Vatican Council, imposes particular caution in consideration of such Entites which have to be considered from their ontological nature. The purely operational aspect - patrimonial and more in general the negotiating - does not characterize these Entities but simply rappresents a functional aspect. The legal personality of which Bishopric and Parish "enjoy" does not arise as a criterion for their classification among the subjects of law: Bishopric and Parish are not legal entites but they enjoy legal personality but, in the fulfillment of their negotiation activities, they are represented by the Bishop and the Parson. Even the legal nature representation can not, accordingly, be brought back to the organicistic theories that characterize the Entities in general however must be analyzed in reason of the actual operation reserved in the specific field of hierarchical Entities. | ||
