Ciertamente, esta forma de obrar es un heco insólito que plantea una serie de cuestiones en su estudio e interpretación además de las técnicas. Si constituye una ruptura con los principios que inspiraron el texto de 1983, o si más bien se trata de aplicar y explicar esos mismos principios fomentando el papel del derecho penal dentro de la acción pastoral de la Iglesia. La cuestión se analiza en relación con la nueva disposición de las penas expiatorias en el nuevo Libro VI del CIC. Para ello se recorren de forma muy sintética las vicisitudes del derecho penal canónico desde el CIC 1983 hasta la Constitución Apostólica "Pascite gregem Dei". Se analizan los nuevos elementos del Libro VI según la Constitución Apostólica con la que se ha promulgado el nuevo Libro, asi como la función del derecho penal en "Pascite gregem Dei". Por ultimo, se considera el lugar que ocupan las penas expiatorias en el nuevo marco juridico, para finalmente exponer las conclusiones alcanzadas. | ||
| 520 | |a The Apostolic Constitution Pascite gregem Dei has replaced all of Book VI of the Code of Canon Law, intending to offer an overview of the substantive criminal law of the Latin Church. This conduct is certainly unusual and raises a seriesof questions in its study and interpretation, in addition to the techniques employed; whether it constitutes a break with the principles that inspired the 1983 text, or if it is rather a question of applying and explaining those same principles, promoting the role of criminal law within the pastoral action of the Church. The issue is analysed in relation to the new provision of expiatory penalties in the new Book VI of the CIC. To do so, the vicissitudes of canonical criminal law from the CIC 1983 to the Pascite gregem Dei Constitution are covered (explored/reviewed?) very concisely. The new elements of Book VI are analysed according to the Apostolic Constitution with which the new Book has been published, as well as the role of criminal law in Pascite gregem Dei. Finally, the place occupied by expiatory penalties in the new legal framework will be considered to present the conclusions reached. | ||
