| Summary: | The motu proprio Omnium in mentem, signed by the pope on the 26th of October 2009, modifies five canons of the Code of Canon Law. The first two are modified to specify the nature of the deaconate within the sacrament of Holy Orders. The three others eliminate the exemption of three rules of marriage law for those who left the Church by a "formal act".The Code of Canon Law nonetheless prescribed that they were not bound by three ecclesiastical laws. Law having effect but for the future, civil weddings or weddings celebrated without dispensation for the faithful, before the entry into force of the law, will or will not be valid according to the opinion of the judge who will consider that they have left the Church by a formal act. Though the question is under discussion, it would seem that the judge may use the criteria established by the Pontifical Council in its letter of 2006. « Modifications du Code de Droit canonique par le motu proprio Omnium in mentem - Modifications in the Code of Canon Law by the motu proprio Omnium in mentem », Philippe TOXÉ. Le motu proprio Omnium in mentem, signé par le pape le 26 octobre 2009, modifie cinq canons du code latin. Les deux premiers ont été modifiés pour préciser la nature du diaconat au sein du sacrement de l’ordre. Les trois autres suppriment l’exemption de trois règles de droit du mariage dont bénéficiaient jusque là ceux qui avaient quitté l’Église par un acte formel. La loi n’ayant des effets que pour l’avenir, les mariages civils ou dispars célébrés sans dispense par des fidèles, avant l’entrée en vigueur de la loi nouvelle, seront ou non valides selon que le juge estimera que ces fidèles ont quitté l’Église par un acte formel. Bien que la question puisse être discutée, il semble que le juge puisse se référer aux critères établis par le Conseil pontifical dans sa lettre de 2006. |
