The present article wishes to discuss a sample of about fifty sentences examined by the sacred Rota tribunal, from 1929 to our day, questions asked to reply to the dubitum for which they were addressed. It shows that the introduction of homosexuality as a case for annulment encountered a rather contrasted history. It has gone from great reticence of the Sacred Rota to a much more frequent acceptance by the roman tribunal. This evolution takes in to a great extent the passage from a realistic conception of marriage as the exclusive right to the body (ius in corpus), as expressed in can. 1081 § 2 de 1917, to a more spiritualist conception of marriage, as a consortium omnis vitae of the 1983 Code. | ||

Le présent article s’attache à étudier un échantillon d’environ cinquante sentences rotales, de 1929 à nos jours, ayant eu à examiner ces questions pour répondre au doute dont la Rote était saisie ; il montre que l’admission de l’homosexualité comme chef de nullité a connu une histoire contrastée, passant d’une grande réticence de la Rote à une admission de plus en plus fréquente par le tribunal romain. Cette évolution recouvre largement le passage d’une conception réaliste du mariage comme droit exclusif sur le corps, tel que l’exprimait le can. 1081 § 2 du code de 1917, à la conception plus spiritualiste du mariage comme consortium omnis vitae du code de 1983. | ||
