Elles se déploient en outre dans un contexte social où la tradition du droit écrit n’est pas encore totalement établie. On peut donc légitimement penser que vingt-cinq années d’existence du Code de droit canonique ne constituent pas un temps assez long pour en faire le bilan. Cependant, le département de Droit canonique de l’Université d’Afrique centrale a voulu examiner, à partir de quelques exemples, la manière dont le Code de droit canonique est reçu dans les Églises d’Afrique centrale : expériences de mise en œuvre des institutions canoniques, création du droit particulier, difficultés d’appropriation du Code. La longue histoire de l’Église nous montre que le thème de la réception a suscité nombre de difficultés menaçant la communion et tentant de déstabiliser le principe d’unité, mais elle reste un facteur déterminant pour l’effectivité du droit de l’Église aujourd’hui. Les Églises d’Afrique centrale sont appelées à poursuivre leurs efforts d’actualisation du Code de droit canonique. Deux voies ont été explorées dans ce sens. D’un côté l’approfondissement et la concrétisation du concept d’Église-Famille de Dieu, de l’autre le renforcement de la bonne gestion des biens temporels, gage de l’avènement d’Églises pleinement constituées. | ||
| 520 | |a The particular Churches of central Africa are young. At the time of promulgation of the Code of Canon Law in 1983, they were not a hundred years old. They exist in a social context where the tradition of written law is not quite wholly established. One can legitimately consider that the twenty five years of existence of the Code of Canon law do not constitute a sufficiently long period to draw up an assessment. However the department of Canon Law in the University of central Africa wanted to examine, from few examples, the manner in which the Code of canon Law is received in the Churches of central Africa : setting up and starting off canonical institutions, the creation of particular frameworks of law, and difficulties of appropriation of the Code.The long history of the Church shows us that the theme of reception has often raised difficulties which jeopardize the communion and strive to destabilise the principle of unity, but the notion of reception remains a determining factor for the effectiveness of law in the Church to-day.The Churches of central Africa are called on to pursue their efforts of actualisation of the Code of Canon Law. Two lanes have been explored in this direction. On the one hand the more thorough study and concretisation of the Church-Family of God, and on the other correct management of temporal goods, which is the proof of fully constituted Churches. | ||
