La gestion des dossiers du personnel ecclésiastique présente le défi de respecter et de maintenir la confidentialité et la vie privée. Dans la plupart des cas, les informations contenues dans les dossiers personnels du clergé, des membres des instituts religieux et des autres personnes occupant des fonctions ecclésiastiques sont confidentielles, ce qui devrait permettre de préserver la réputation de toutes les personnes concernées. D’un point de vue juridique, le devoir inné de l’Église de respecter la dignité de la personne, ainsi que le droit naturel à la vie privée et à la bonne réputation, constituent le fondement de cette étude. Certaines pratiques de l’Église impliquent la collecte, l’utilisation ou la conservation d’informations confidentielles sur des personnes à des fins internes, pour l’administration de la justice et pour la gestion des archives et des documents dans la curie diocésaine. En définitive, l’Église a la responsabilité de protéger la vie privée de tous les fidèles et de transmettre le message de l’Évangile en toute transparence. | ||
| 520 | |a This study explores the concepts of confidentiality and the right to privacy in contemporary moral and legal thought. The management of church personnel files presents the challenge of observing and maintaining confidentiality and privacy. In most cases, the information contained in personnel files of the clergy, members of religious institutes, and others holding ecclesiastical offices is confidential, which should safeguard the reputation of all persons involved. From a juridical viewpoint, the Church’s innate duty to respect the dignity of the person, as well as the natural right of privacy and good name, forms the foundation of this study. Certain practices in the Church entail the collection, use, or retention of confidential information about individuals for internal purposes, the administration of justice, and the management of archives and documents in the diocesan curia. In the final analysis, the Church has the responsibility both to protect the privacy of all the faithful and to transmit the Gospel message transparently. | ||
