Il est vrai qu’en ouvrant la Procréation Médicalement Assistée (ou Assistance Médicale à la Procréation) aux couples de femmes et aux femmes seules non mariées, la loi marque une rupture avec l’ancien droit de l’AMP fondé sur une médicalisation forte de cette technique d’assistance à la procréation. Cette rupture apparaît justifiée par une volonté d’égalisation des projets parentaux. Il n’en demeure pas moins que le « nouveau » droit de l’AMP reste traversé par des différences de traitement entre les différents demandeurs et demandeuses en raison de leur sexe et/ou de leur orientation sexuelle. | ||

It is true that opening up the MAP to female couples and single women made the law depart from the former legal framework which was based on a strong medicalization of this assisted procreation. This shift seems to be justified by the legislator’s intent to ensure equal rights when it comes to parental projects.
