Pope Francis is demanding "the renewal of structures" of the Church (Evangelii Gaudium 27). There is a paradigm shift towards the new human rights perspective, which entered the Council with the encyclical Pacem in ferris (1963). Paul VI deepened it with the "Lex Ecclesiae Fundamentalis" project, which is not yet promulgated. | ||
| 520 | |a Dieser Artikel reflektiert die vielfachen Dienste, die die Theologie dem kanonischen Recht erweisen kann. Sie kann das kanonische Recht vor Legalismus und rechtlichem Positivismus bewahren, indem sie sich auf die Werte und Ideale beruft, die aufrechterhalten werden sollen. Indem sie dem kanonischen Recht hilft, die Zeichen der Zeit zu lesen, kann die Theologie bei der Beantwortung der gegenwärtigen Notlagen der Gläubigen und vor Gefahr zu Überaltern Hilfestellung leisten. Darüber hinaus könnte die Theologie im Kontext einer Pluralität von lokalen Kirchen bei der Formulierung teilkirchlicher Normen helfen, die ihren konkreten Situationen vor Ort am besten entsprächen. Es braucht eine theologische Klarheit darüber, was göttliches Recht ("ius divinum") und was kirchliches Recht ist, wobei auch die Durchlässigkeit zwischen beiden Sphären zu beachten ist. Ein fortlaufender Dialog zwischen Theologie und Kirchenrecht ist dieser Tage nötig, um den Gläubigen heute wirksam zu dienen. | ||
