Diese verbleiben in klerikalen Instituten päpstlichen Rechts innerhalb der Institute, da ihre höheren Oberen nach c.134§1 Ordinarius für ihre Mitglieder sind. Gemäß des von Papst Franziskus am 18. Mai 2022 ausgestellten Reskripts an das DIVCSVA können in diesen Instituten im Ausnahmefall auch Laien höhere Obere sein. Allerdings steht in Frage, ob auch diese Ordinarius für ihre Mitglieder sind. Alle Institute aber, die keinen eigenen Ordinarius haben, stellen die mit dem Ordinarius verbundenen Regelungen vor besondere Herausforderungen hinsichtlich ihrer Autonomie gemäß c.586§1. Insbesondere wenn vom Ordinarius proprius die Rede ist (c.1265§1, c.1288 und c.1302§3), bleibt teilweise schon im Text und auch in der kirchenrechtlichen Literatur unklar, wer eigentlich gemeint ist. 
520 |a The Ordinary has certain competences in the temporal gods law of institutes of consecrated life. These remain within the institutes in clerical institutes of pontifical law, since their major superiors are ordinaries for their member saccording to c.134§1. According to the rescript issued by Pope Francis to the DIVCSVA on 18 May 2022, lay people can also be major superiors in these institutes in exceptional cases. However, it is questionable whether they too are ordinaries for their members. All institutes that do not have their own ordinarius, however, face special challenges with regard to the regulations associated with the ordinarius in terms of their autonomy according to c.586§1. In particular, when the ordinarius proprius is mentioned (c.1265§1, c.1288 and c.1302§3), it remains unclear in part already in the text and also in the canon law literature who is actually meant.
