520 |a An inquiry above a correct systematic of the relations between Theology and Canon Law seems to be suitable chiefly in the era of recent reforms that are affecting the Church. The applicative relevance of such an attempt finds its deepest "raison d'être" in the shifting of the axis that a proper framing of the mutual connection can bring, moving from a sphere of ontological investigation, where one risks, as the history has shown, an undue indistinction between the two subjects - considering every component of Canon Law as theological, even misunderstanding its most basic legal connotation, and, at the same time, connoting every theological statement as juridical, - to a, more correct, methodological one. The latter, relying on the constitutional status of the Church, constituted by the "norma missionis ", which must be, similarly, its starting point and its goal to follow, allows us to speak of a "Theology of Canon Law", which can be used as an interpretative parameter, consenting, also through an exact relocation of elements often misinterpreted, as "communio" and "ius divinum", a more correct ford from the biblical and theological field to the juridical one. In this way, it will be easier to strain what, in the Church, belongs to the will of its Founder and how, instead, the Church Itself,· as a divine institution but also human, has had to give Itself through times and history in order to interface with the essential needs of inculturation. The epilogue that we propose could also fulfil! the function of connecting back to Law that relational role that develops in a bottom-up way, without any claim to absolutize every command on the basis of alleged divine selfinvestiture that risk, indeed, to make lose the horizon of what in the Church is truly sacred and immutable by human actions.
