Description
Summary:The retention of bulls and other pontifical provisions was a royal privilege that the 19th Century ―that of liberalism, constitutions and codes― inherited from the absolute monarchy through the Novísima recopilación. The present work intends to follow its trail through the successive criminal corpus until reaching the current Code of 1995, bringing us near to the end of the last century; and for this, attention is paid not only to the law itself, but also to doctrinal theorization and even to jurisprudential practice.
Fue la retención de bulas y otras disposiciones pontificias una regalía que el siglo XIX ―el del liberalismo, las constituciones y los códigos― heredó de la monarquía absoluta por conducto de la Novísima recopilación. El presente trabajo pretende seguir surastro a través de los sucesivos corpus penales hasta recalar, ya a finales de la pasada centuria, en el vigente articulado de 1995, atendiendo para ello, no solo a la propia leyy su génesis, sino además a la teorización doctrinal e incluso a la práctica jurisprudencial.
