| 520 | |a El fundamento teológico de la Conferencia episcopal ha de considerar el vínculo colegial, la índole colegial del episcopado y las diversas formas de ejercer la colegialidad, unas veces de modo efectivo como en el Concilio ecuménico, otras veces en el denominado afecto colegial como en las Conferencias episcopales, que no es acto colegial en sentido jurídico y, sin embargo, plantea la cuestión sobre la obligatoriedad de sus decisiones y el fundamento de la vinculación a estas. La respuesta al interrogante necesariamente tiene en cuenta la enseñanza conciliar y la reflexión posterior, la referencia al Código de Derecho Canónico, al Sínodo de los Obispos de 1985 con su consiguiente debate y a la Constitución apostólica Apostolos suos. De estas referencias se puede concluir que las decisiones de la Conferencia Episcopal, con la recognitio de la Sede apostólica, vinculan a los obispos de esta, no por la autoridad del Colegio o del Papa, sino por la autoridad propia de la Conferencia, derivada de la puesta en acto de modo conjunto de la potestad de cada obispo. | ||
| 520 | |a The theological foundation of the Episcopal Conference should be considered as the official assembly, the collegiate form of the episcopate, and the varied ways of exercising the collegiate, sometimes effectively such as in the Ecumenical Council, others as collegiate friendship such as in the Episcopal Conference, which is not a collegiate event in the legal sense but nevertheless poses questions about whether its decisions are obligatory and the basis for their binding nature. The answer to the question necessarily takes into account conciliar teaching and subsequent reflection, reference to the Canonical Law Code, the 1985 Bishops’ Synod with its subsequent debate and to the Apostolic Constitution Apostolos suos. From these references it can be concluded that the decisions of the Episcopal Conference, with the recognitio of the Apostolic See, are binding for the Bishops in it, not by the authority of the College or the Pope, but by the Conference’s own authority, derived from the joint application of the power of each Bishop. | ||
