Un requisito imprescindible es que ambas partes estén previamente de acuerdo sobre el contenido de los hechos controvertidos y sobre el uso de este procedimiento abreviado. Otra de las novedades más destacadas reside en el ejercicio directo del Obispo de su ministerio judicial: el Obispo es el juez y por tanto el único que debe alcanzar la requerida certeza moral para dictar sentencia, que siempre será de signo afirmativo, pues no cabe una sentencia negativa, sino que el mismo Obispo determinará el paso de la causa al proceso ordinario ante su tribunal eclesiástico. La instrucción será realizada por un juez instructor, que podrá ser el mismo vicario judicial o una persona competente para tal cometido; la instrucción deberá ejecutarse a ser posible en una única sesión. El defensor del vínculo deberá preparar sus observaciones, y las partes podrán aportar sus escritos de alegaciones, con lo que se da lugar a la fase discusoria de la causa. A la hora de tomar la decisión, el Obispo deberá consultar condos asesores, uno de los cuales será el propio instructor y el segundo podrá ser un experto en derecho u otras ciencias precisas para resolver el caso. Es únicamente el Obispo quien debe adquirir la certeza moral para dictar la sentencia, que podrá ser apelada por las partes ante el Metropolitano o ante la Rota romana, que –si es admitida– enviará la causa al examen ordinario en el segundo grado. | ||
| 520 | |a The Motu Proprio Mitis Iudex Dominus Iesus, among other relevant legislative novelties in relation to the marriage annulment process, introduces a new and shorter process before the diocesan Bishop for those evident nullity causes which proof can be easily collected and therefore do not require very detailed proceedings. An indispensable requirement for this is that both parties have a previous agreement on the content of the facts in issue and on the use of this simplified process. Another of the most prominent novelties is the direct practise of the Bishop of his judicial ministry: the Bishop is the judge and therefore the only one who has to reach the required moral certainty to pronounce a sentence, which will always be positive, since there is no room for a negative sentence because then the Bishop himself will determine the lawsuit to be moved to the ordinary process before its Ecclesiastic court. The proceedings will be carried out by an investigating judge that could be the judicial vicar himself or a competent person for that task; the proceedings will be executed if possible in a single session. The one defending the bond will have to prepare its remarks and both parties will be able to provide their pleadings giving rise to the debate phase of the lawsuit. To make a decision, the Bishop will have to consult two advisers, one of which will be the investigating judge himself and the second one could be an expert in law or other exact sciences. It is only the Bishop that has to achieve the moral certainty to pass sentence. The sentence can be appealed by the parties before the Metropolitan or the Roman Rota, which if accepted will send the lawsuit to the ordinary examination in the second grade. | ||
