| 520 | |a El ejercicio del ministerio episcopal, desde sus orígenes, está necesariamente ligado a cumplir la misión de juez entre los miembros del Pueblo de Dios. Los obispos, primero en la clandestinidad y luego abiertamente, están llamados a resolver las disputas surgidas entre los fieles, hasta que llegó el momento en el cual el Imperio les reconoce la capacidad para ser jueces oficiales. Sin embargo, que los obispos llegasen a ser jueces oficiales, si bien fue causa de tener amparo legal y permitió cumplir las pretensiones bíblicas de que toda causa entre creyentes no fuera conocida por paganos, también generó ciertos problemas. En efecto, muchos son los obispos que se lamentarán por tener que cumplir oficialmente este cometido, que les restaba tiempo para poder realizar otras funciones y les ponía en una situación complicada con respecto a sus fieles. Nuestro trabajo se centra en tres aspectos: en primer lugar, el fundamento teológico de la administración de justicia, tanto bíblico como patrístico, para entender de qué modo debe ser ejercida una misión que debe ser llevada a cabo sin olvidar el objetivo de la salvación; en segundo lugar, el proceso de oficialización de la episcopalis audientia hasta llegar a la legislación constantiniana y, finalmente, el modo de ejercer el officium iudiciorum por parte de los obispos y los problema derivados de ello. | ||
| 520 | |a The bishops, first clandestineness and then openly, are called upon to resolve disputes that have arisen among the faithful, until the time in which the Empire recognized them the capacity to be official judges. However, that bishops should be official judges, although it was given them legal protection and allowed to meet the biblical claims that every cause among believers were not known by pagans, also created certain problems. In fact, there are many bishops who regret having to officially accomplish this task because was taken them time to carry out other functions and put them in a situation complicated with respect to the faithful. Our work focuses on three aspects around this institution: firstly, the theological of the administration of Justice, both biblical and Patristic Foundation, to understand how must be exercised a mission that must be carried out without forgetting the purpose of salvation; Secondly, the process of episcopalis audientia in Constantinian legislation and the first limit of jurisdiction and, finally, the way of exercise of the offcium iudiciorum by bishops and the problem arising from this. | ||
